About these Terms

These Terms of Use govern access to nestifi.money, its public pages, demonstrations, educational materials and related communications (the “Website”). The Website is operated by NestiFi Technologies Limited, an Irish company (“NestiFi”, “we”, “us” or “our”).

By using the Website, you agree to these Terms. If you use the Website for an organisation, you confirm that you are authorised to act for that organisation. Mandatory rights that cannot lawfully be excluded remain unaffected.

What NestiFi provides

NestiFi provides technology infrastructure that helps credit unions, community banks, registered investment advisers, wealth firms and platform partners deliver branded family-finance, financial-literacy, planning and engagement experiences.

Banking, brokerage, investment-advisory, custodial and other regulated services available through a NestiFi-powered experience are provided by the participating institution or an appropriately authorised provider. NestiFi does not hold customer funds or securities, execute securities transactions or make investment recommendations.

Financial institutions and regulated partners

A NestiFi-powered experience is delivered by a participating financial institution or other regulated organisation. That organisation, together with any authorised provider it identifies, is responsible for the banking, brokerage, advisory, custodial, identity-verification or other regulated service it provides.

Any account, product or regulated service is subject to the applicable provider’s agreements, eligibility requirements, fees, disclosures and privacy notice. Those documents control over this Website where they address the relevant product or service.

The availability of any feature, product, deposit insurance or investor protection depends on the institution, partner, market and jurisdiction. No such protection arises merely from use of NestiFi software.

Education, planning tools and Seb

Website content and NestiFi software may include educational material, financial-literacy experiences, calculators, illustrative projections and the Seb AI assistant. These features are intended to explain concepts, organise information and support institution-controlled workflows.

Seb does not make investment recommendations, select financial products, provide personalised investment advice, make credit decisions or replace an authorised professional. AI-generated content may be incomplete, inaccurate or inappropriate for a user’s circumstances and should be reviewed before it is relied upon.

Illustrations are not forecasts or guarantees. Actual outcomes may differ and investments can lose value. You should consult the relevant institution or an appropriately qualified professional about financial, investment, legal or tax decisions.

Permitted use

You may use the Website for lawful informational and business-evaluation purposes. You must not:

  • interfere with the Website, attempt unauthorised access or test its security without written permission;
  • copy, scrape, reverse engineer or exploit the Website except where applicable law expressly permits it;
  • introduce malicious code, misuse forms, impersonate another person or submit information you are not authorised to provide;
  • use Website content to mislead consumers or imply that NestiFi provides a regulated service that it does not provide; or
  • violate intellectual-property, privacy or other rights.

Intellectual property

The Website, NestiFi name and branding, software, interfaces, designs, written material and other content are owned by NestiFi or its licensors and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive and non-transferable right to access the Website in accordance with these Terms. No other licence or right is granted by implication.

Website information and third-party links

We aim to keep public information accurate and current, but the Website may contain errors or become outdated. Product descriptions present a general direction and do not promise that a feature is available in every deployment.

The Website may link to third-party sites. NestiFi does not control those sites and is not responsible for their content, security, availability or privacy practices.

Availability and changes

We may update, suspend or withdraw all or part of the Website, change its content, or restrict access where reasonably necessary. We do not guarantee uninterrupted or error-free availability.

Privacy and children

Our Privacy Notice explains how NestiFi handles personal data. The public Website is directed to adults and institutional representatives, not to children under 13.

Institution-deployed family experiences may involve children. Where required, an institution, parent or guardian must provide appropriate authorisation or verifiable parental consent before a child’s personal data is processed. Additional product-specific notices may apply.

Disclaimers

To the extent permitted by law, the Website is provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes a warranty, remedy or liability that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by law, NestiFi will not be liable for indirect, incidental, special, consequential or punitive loss arising from use of the public Website, including loss of profit, opportunity, data or goodwill.

This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Liability relating to a customer deployment is governed by the applicable written agreement.

Suspension and termination

We may suspend or terminate access to the Website where we reasonably believe these Terms have been violated, security is threatened or suspension is required by law. Provisions intended to survive termination, including intellectual-property, disclaimer and liability provisions, will continue to apply.

Changes to these Terms

We may update these Terms as NestiFi, the Website or applicable law changes. The updated version will be posted here with a revised effective date. Material changes may also be communicated through an appropriate additional notice.

Governing law

These Terms are governed by the laws of Ireland, without regard to conflict-of-laws principles. The courts of Ireland will have jurisdiction, subject to any mandatory consumer right to bring a claim elsewhere.
